Recently, the Japanese government submitted an amendment to its Copyright Act in a regular session of the Diet aimed at dealing with infringement and cracking down on illegal pirate websites. The amendment proposes penalties for the opening and operating of "leech" websites and similar applications, creating stricter regulations on hyperlinks on said sites that link to illegal content elsewhere. The amendment also addresses the associated liability of the developers and administrators of such websites and applications. Vietnam is among the countries that have the least respect for copyright and creative efforts in Asia. Leech sites existed long before the internet became popular in Vietnam, and the loose management and lack of specific detail in the legislation on online copyright infringement encourage users to infringe and profit on the backs of copyright owners’ hard work. This thesis evaluates the legal provisions that Japan has put forward in the handling of leech sites, and comments on their effectiveness with a constructive review and evaluation. Such an evaluation can help provide a model for Vietnamese legal policies in handling leech sites, online piracy and the responsibilities of internet service providers.
